Possession of Drug Paraphernalia
Even if you are not charged with possessing any illegal drugs, you still may be criminally prosecuted for possessing drug paraphernalia. The term ''drug paraphernalia'' generally refers to any equipment, product, or material of any kind which is primarily intended or designed for use in manufacturing, compounding, converting, concealing, producing, processing, preparing, injecting, ingesting, inhaling, or otherwise introducing into the human body an illegal controlled substance. Drug paraphernalia include:
- Hypodermic needles
- Pipes (metal, wooden, acrylic, glass, stone, plastic, or ceramic)
- Water Pipes
- Roach Clips
- Miniature Spoons
- Chillums (cone-shaped marijuana/hash pipes)
- Bongs
- Rolling papers
- Cocaine Freebase Kits
- Carburetion Tubes and Devices
If you are arrested and charged for possessing drug paraphernalia relating to marijuana use, you may have good grounds to have the charges dismissed against you if you have a valid medical marijuana prescription in California.
