Aiding or Abetting the Use of Controlled Substances

If someone uses an illegal drug in home, car, office, boat, plane, or even in your presence, you may be charged with aiding or abetting the use of a controlled substance. If you knew that the person was going to use an illegal drug, and you intended to assist that person in using the drug, by allowing them to do so in your home, car, office, boat, plane or by being in your presence, you may be subject to criminal penalties, including fines and jail time. However, the fact that a person is present at the scene of a crime or fails to prevent the crime does not, by itself, make him or her an aider and abettor.
